Toyota Considering Recall of 2010 Corolla

Corolla Recall Steering Problems – Toyota is considering a recall of its top-selling Corolla subcompact after complaints about power steering problems. Toyota recalls 8000, 4 Wheel drive 2010 Tacoma Trucks

Toyota announced a voluntary safety recall of about 8,000 four-wheel-drive 2010 Tacoma trucks in North America. Sources are speculating that certain vehicles from Ford Motor Co. and Nissan Motor Co. may also be involved in this recall. Toyota states the front shaft in a small production run of pickups may include a component that developed cracks during the manufacturing process. The automaker said Friday, as the vehicles are used, the cracks could lead to the separation of the drive shaft at the joint portion. Driving your Tacoma under these conditions may lead to serious injuries or fatalities due to the potential loss of control while driving your Tacoma. Toyota Hides Camry Recall - Within the Press Release about Pruis

If you didn’t catch the hidden safety recall for the 7,300, 2010 Toyota Camry, within the press release about the Toyota Prius recall. M&A law firm has provided an excerpt from the press release is as follows:

Separately, Toyota will conduct a voluntary safety recall on approximately 7,300 early production – 2010 model year Camry vehicles equipped with the 4 cylinder engine to inspect for a power steering hose that may be in contact with a front brake tube. This contact could lead to a hole in the brake tube and cause a brake fluid leak, increased brake pedal stroke and greater vehicle stopping distance. Owners of the involved 2010 Camry vehicles will be notified by mail starting in the middle of February.

The issues is on certain early production 2010 model year Camry vehicles equipped with the 4-cylinder engine, a power steering pressure hose in the engine compartment may be the incorrect length. If this condition exists, a crimp on the power steering pressure hose may come in contact with the No. 7 front brake tube. If this condition is not fixed, a hole may wear in the brake tube and deplete the brake fluid in the vehicle? As a result, the brake pedal stroke will increase and lead to greater vehicle stopping distance which may lead to hazardous and even fatal driving conditions. Toyota will notify owners by mail starting in mid-February 2010.

Toyota Announces Recall on 2010 Prius and Lexus HS250h Vehicles

Toyota Motor Sales, U.S.A., Inc, announced a voluntary safety recall on approximately 133,000 2010 Model Year Prius vehicles and 14,500 Lexus 2010 HS 250h vehicles to update software in the vehicle’s anti-lock brake system (ABS). This recall does not include Toyota, Lexus, or Scion vehicles. The ABS system prevents wheel lock-up by automatically modulating the brake pressure during an emergency stop. By preventing the wheels from locking, it enables the driver to maintain steering control and to stop in the shortest possible distance under most conditions. Some 2010 model year Prius and 2010 HS 250h owners have reported experiencing inconsistent brake feel during slow and steady application of brakes on rough or slick road surfaces when the ABS is activated in an effort to maintain tire traction. This faulty software can potentially lead to serious injuries or fatalities, due to the loss of braking control in the 2010 Prius and 2010 Lexus HS 250h Vehicles.

Toyota Owners Are Seeking Economic Damages

Toyota has recalled around 8.5 million vehicles and now faces a growing number of consumer class-action cases, over the shrinking resale value of its recalled models. The consumer class actions are based on the premise that for Toyota car buyers “if you went to sell your car today, it’s worth a lot less than it was two weeks ago.” Consumer lawsuits seeking economic damages for diminished value or lost use of a recalled Toyota vehicle have been filed in at least 30 states, mostly in federal court. All the federal suits would be consolidated into a single class action in the next three to four months, following a hearing before a panel of judges set for March 25 in U.S. District Court in San Diego. Toyota Dealerships to take Extraordinary Measures On Recall

On Monday, Toyota apologized to their U.S. customers over a massive recall of its vehicles and publicly promised that Toyota dealerships will undergo "extraordinary measures" to fix accelerator pedals involved in the recall. The pedal issue first surfaced in October, after 19 lives had already been taking by the faulty pedal.

"First, I want to sincerely apologize to Toyota owners," Jim Lentz, president and chief operating officer, said in a video posted on the company's Web site. "I know that our recalls have caused many of you concern and for that I am truly sorry." He also mentioned, "I drive Toyotas. My family members drive Toyotas," he said. "I would not have them in products that I knew were not safe."

Dealers should receive the new parts not later than February 8th, Toyota said. Some dealers will stay open 24 hours in order to make the repairs. The pedal issue stems from a friction device that provides the proper touch and response in the pedal by adding resistance and making the pedal steady and stable, however, parts of the friction device can begin to stick instead of operating smoothly. Toyotas’ solution is a steel reinforcement bar that will be installed into the assembly eliminating the pedals excess friction. Toyota has confirmed the effectiveness of the newly reinforced pedals through rigorous testing on pedal assemblies that had previously shown a tendency to stick.

With the new solution to their recall, Toyota still faces negative impacts on their production, sales and their brand value.

TOYOTA PRIUS’ RECALLED – Brake Failure

In the most recent update from Toyota Motor Company, it will recall 270,000 hybrid Prius cars in the U.S. and Japan, the Nikkei News Service reported. The recall will target the third-generation Prius launched in May. Last Thursday, The Transportation Department opened an investigation into brake problems in the 2010 Prius, and Toyota acknowledged the design problems with the brakes, but said it was still deciding how to inform customers and whether a recall is needed. The Japanese government ordered Toyota to investigate brake problems in the Prius. The preliminary evaluation involves about 37,000 vehicles sold in the United States in May 2009. The Transportation Department’s safety agency, said it has received 124 reports from consumers experiencing a pause in the braking when the vehicle switches between the traditional hydraulic brakes and the electronically operated braking system. Toyota acknowledged the brake problem while reporting a $1.7 billion profit for its October-December quarter.

Qualitest Pharmaceuticals Issues Recall for

All Accusure® Insulin Syringes

Alabama-based company has recalled 250 million Acusure insulin syringes after complaints were derived from Qualitest Pharmaceuticals. The pharmaceutical company claims the needle was detaching from the syringe. So far, no reports of injury or death have been reported, however, if the needle becomes detached during use, it can become stuck in the insulin vial, push back into the syringe, or remain in the skin after an injection. All Acusure insulin syringes will be recalled that were distributed between January 2002 and October 2009 to all consumers including wholesale and retail pharmacies. The syringes will be sent back to the Alabama-based company from many different manufacturers. Consumers who have these products should stop using them and contact the company. The distributed syringes are of the following descriptions and NDC numbers:

Product Liability Law

Products liability law is a tort action that falls under negligence (unintentional tort action) umbrella. Simply, products liability laws holds all parties involved in the chain of manufacturing and distribution of any defective product are responsible for causing injuries. Aside from the actual manufacturer, other responsible parties may include distributors, retailers, repairers, assemblers, component suppliers and testing laboratories. Although products liability claims started under negligence theory, today in addition to negligence action, it can be based on strict liability, breach of warranty, and various consumer protection claims.

Negligence

To prove negligence, the plaintiff must demonstrate that the parties responsible for placing the product into the stream of commerce had a duty to provide goods fit for their foreseeable uses; that they would have detected the defect by the use of reasonable care in the design, manufacture or inspection process, but failed to do so; and that the plaintiff was injured by the product as a result of the defect while engaged in a foreseeable use.

Strict Liability

Under a strict liability standard, once the plaintiff establishes that a product is defective, liability immediately attaches from that fact alone no matter how much care was taken during the design, manufacture, marketing, distribution and sale.

UCC Warranty

Under a breach of express warranty theory, the plaintiff claims a violation of the actual written warranty associated with a product. Under a breach of implied warranty theory, the plaintiff alleges that although there is no express warranty or the defect alleged is not covered by the express warranty, a defect in the product makes it unfit for its intended purpose.
